ConsensusDocs Now 41-Strong, New Contracts

ConsensusDocs Releases New Constructor & Consultant Agreements

ConsensusDocs recently released the new ConsensusDocs 746 Constructor & Geotechnical Consultant Agreement and the 747 Constructor & Consultant Agreement. These new contracts provide an industry standard contract for a constructor who wants to retain a consultant on a construction project. Similar to the ConsensusDocs 246 and 247 (Owner and Consultant agreements), these constructor and consultant agreements were crafted to provide a solid contractual base for a variety of consulting arrangements, including interior design, inspection, industrial hygiene, retrofits, procurement and many others.

“The new agreements between constructors and consultants fill the need for fair and balanced, industry-standard contracts that protect constructors and consultants alike, and help ensure that both parties understand their roles and responsibilities,” stated, Phil E. Beck, Esq., Partner at Smith Currie & Hancock LLP.

As with all ConsensusDocs contract documents, the new agreements incorporate a plain English writing style that facilitates contract interpretation and administration. The contracts take a project-first approach and promote collaboration, communication and integration, which minimize contractual silos that impede efficiency.

ConsensusDocs Continues to Grow in Number of Endorsing and of Supporting Members

ConsensusDocs continues to grow by gaining more industry organizations that want to support the mission of the Coalition through promotion and education and those that want to become an endorsing member.

In January, ConsensusDocs signed agreements with the following three organizations for these various arrangements:

1. SmartBidNet – They will include the ConsensusDocs 721 Subcontractor Statement of Qualifications (and perhaps other ConsensusDocs prequal forms in the future) in their software.
2. International Heavy Lift (IHL) – They will provide a ConsensusDocs link and information on their website for their users. IHL is a forum for folks involved in the heavy aircraft industry (e.g., airlifting of materials, etc.)
3. Lorman’s Association of Construction and Development – They will provide a ConsensusDocs link and information on their website for their users.

Also, this month, the U.S. Hispanic Construction Association (USHCA) has joined becoming the 41st endorsing member of the ConsensusDocs Coalition. For more information, visit www.ConsensusDocs.org.
