ConsensusDocs New Contract

New Federal Design-Build Agreement Makes it Easier for Design Professionals and Design-Builders to Contract on Federal Design-Build Projects

ConsensusDocs has published the industry’s first standard design-build agreement for design professional services on federal projects, ConsensusDocs 422, Design-Builder/ Design Professional Federal Projects Agreement. The comprehensive agreement provides the business and contractual terms and conditions for a design-builder to hire an architect or engineer on a design-build project in a manner consistent with federal contracting laws and practices. The new agreement includes language that addresses new regulations for affirmative action requirements for protected veterans and individuals with disabilities from the Department of Labor's Office of Federal Contract Compliance Programs (OFCCP) that recently took effect.

“ConsensusDocs design-build contracts are the most used and useful standard design-build documents that I see in my practice. The new design-build agreement for architect/engineering services provides a valuable off the shelf solution for federal design-build contracting, that will be extremely valuable to design-builders, design professionals, and construction attorneys who serve them," states Tom Kelleher, Senior Partner with Smith, Currie & Hancock LLP and the Chair of the ConsensusDocs Working Group that produced this document.

New Design Professional/Owner Software Package

ConsensusDocs is announcing a new package, "Design Professional/Owner Package," aimed for design professionals who want to use fair and balanced contracts. Design professionals will receive a comprehensive set of standard contract documents on the ConsensusDocs Microsoft Word-compatible technology platform that allows either online or office usage. This package is at a lower cost than an AIA contract documents subscription.

“ConsensusDocs contracts are fair to architects and engineers, insurable, and do not raise the standard of care,” comments Brian Perlberg, Executive Director & Counsel of ConsensusDocs. ConsensusDocs offers design professionals and owners alike a real choice in fair standard contract documents. Self-serving and overly protective contract terms, simply leads to a distrust of gamesmanship, communication siloes, and eventually inflated construction costs and contingencies.” First user license $499 / $399, Additional user licenses (2 - 9) $309 / $249 per additional user.* (Contracts included: 200.2, 220, 221, 222, 240, 245, 250, 270, 271, 280, 281, 291, 292, 296, 300, 301, 310, 420, 421, 422, 491, 492, 498, 499, 721, 803).
