NASBP is please to welcome several new attorneys to the NASBP Attorney Advisory Council (AAC). Adrian A. D’Arcy, David A. Harris, Brian M. Streicher, and David P.J. Timm have joined the AAC, joining Jonathan Bondy of Chiesa Shahinian & Giantomasi PC; Timothy Heffernan of Watt Tieder; Todd Regan of Gordon Rees Scully Mansukhani, LLP; Chad L. David Robbins of Jenner & Block LLP and Gregory R. Veal of Bovis, Kyle, Burch & Medlin, LLC have stepped down from the AAC. Adrian A. D’arcy is a Founding Partner of D’Arcy Vicknair, LLC. His primary practice areas include commercial litigation, surety litigation, construction litigation which he litigates in federal and state courts, and in arbitrations. He is a proponent of resolving matters early in mediation and through alternative dispute resolution if possible so clients can focus on their companies and not on litigation. Additionally, D’Arcy crafts and reviews construction contracts so that clients are protected on the front end of projects. D’Arcy graduated cum laude from Loyola Law School and now teaches a Construction Law and Surety Law class there as an adjunct professor. He has also presented numerous lectures on construction and surety issues over the last 19 years and he continues to speak on these subjects on a regular basis. David Harris is a Partner at Bovis, Kyle, Burch & Medlin, LLC. He represents sureties, contractors and owners in Georgia, North Carolina, and South Carolina. Harris has extensive experience, including: construction defect litigation, claim investigations, indemnity and subrogation rights, payment & performance bond disputes, commercial and miscellaneous bonds, fidelity bonds, fraudulent transfer claims, and creditor rights in bankruptcy. Harris joined Bovis Kyle in 2007, after graduating from Emory School of Law with honors. He is a member of a number of professional organizations and has spoken at the National Bond Claims Association, the Southern Surety & Fidelity Claims Conference, and the Surety Association of Georgia. Brian M. Streicher is Managing Partner of Ernstrom & Dreste, LLP. He is an experienced commercial litigator representing clients involved in commercial and construction disputes—sureties, contractors, design-builders, property owners, construction managers, and corporations. This representation likewise often includes front-end construction and corporate risk management and contract counseling. He also has extensive experience representing financial institutions in commercial and construction financing, real estate financing, and bankruptcy proceedings. Before joining Ernstrom & Dreste, LLP, Streicher practiced for seven years representing financial institutions in the dynamic market of South Florida. Streicher approaches his practice with the mindset that his job is to engineer the best solution to his clients’ issues, within the confines of the law. With that outlook, he understands that there is not one singular path to achieving a desirable result for a client—success can be achieved through judgments in state or federal proceedings, negotiated settlements, or alternative dispute resolution forums. David P.J. Timm is a member of the Burr & Forman Construction & Project Development practice group. He represents contractors and companies in complex disputes, claims, and bid protests involving federal, state, and local government contracts. Timm’s practice includes matters before the Government Accountability Office (GAO), Boards of Contract Appeals, the U.S. Court of Federal Claims, the U.S. Court of Appeals for the Federal Circuit, various state courts, as well as in arbitration and mediation. He also advises clients on regulatory and compliance matters on the federal, state, and local levels, including those involving the Small Business Administration’s (SBA) rules, including the 8(a) program, HUBZone, Small Business Innovation Research (SBIR) and others. In addition to procurement-related litigation, Timm represents clients in civil litigation, internal investigations, and related disputes. His extensive experience with e-discovery adds value for clients navigating complex discovery issues. He also maintains an active U.S. Top Secret security clearance.
Timm is particularly passionate about eviction prevention and currently serves as Chair and Public Interest Representative on the Tenant-Landlord Commission of Arlington County, Virginia, an advisory body to the Arlington County Board that provides guidance and hears a wide range of housing issues. He also regularly writes and speaks on topics related to government procurement, bid protests, and public-sector litigation, and serves as Co-Chair of the firm’s AI Committee and Chair of the Bid Protest Committee for the Federal Bar Association. The AAC, inaugurated by NASBP in 2015, is comprised of distinguished attorneys with broad and deep knowledge and experience in various relevant sectors of the industry, including contract and commercial surety, construction, and/or government contracts. The mission statement for the AAC states as follows:
The NASBP Attorney Advisory Council is constituted for the purpose of serving as a resource team to NASBP and providing substantive content to NASBP for articles, programs, and presentations on surety, government contracts, and construction law topics for the betterment of the surety industry.
The Council participants serve as valuable resources to NASBP, providing outstanding informational content for various articles, virtual seminars, podcasts, and in-person presentations. Be sure to extend a hearty welcome these new Attorney
