Two EJCDC Bid Bond Forms Now Available to the NASBP Membership

NASBP is pleased to announce that both Engineers Joint Contract Documents Committee (EJCDC) Bid Bond Forms are now available for free to the NASBP membership at nasbp.org. In January 2012, EJCDC provided NASBP its recently revised Bid Bond forms, EJCDC C-430 Bid Bond – Penal Sum 2007-2012 edition and EJCDC C-435 Bid Bond – Damages Form 2007-2012 edition.

EJCDC corrected these Bid Bond forms so the parenthetical notation instructs that the date of the bond should be “no later than” the date the bid is due–rather than the incorrect “no earlier than…” wording that had been in the two bonds since 2007. This is the only change. EJCDC may make other minor improvements when the full family of EJCDC Construction series bonds are issued later this year or in January 2013. Note that the new revised versions of EJCDC C-430 and EJCDC C-435 say “2007-2012” in their footer.

The error in EJCDC C-430 Bid Bond – Penal Sum and EJCDC C-435 Bid Bond – Damages Form was an inadvertent, clerical error. Regarding the incorrect EJCDC bid bonds that are already in the hands of engineering firms and owners who are putting together bid packages, EJCDC suggests using the revised form, or revising the incorrect form with a few words of explanation.

NASBP has been providing the NASBP membership access to the EJCDC C-610 Performance Bond and EJCDC C-615 Payment Bond since December of 2010. Access to these four EJCDC Bond Forms requires agreement to the license and instructions followed by prompts to provide a NASBP login and password. NASBP provides these EJCDC bond forms on its web site with additional information about the bond forms at nasbp.org.

The Engineers Joint Contract Documents Committee (www.ejcdc.org), is a joint venture of four associations, the American Council of Engineering Companies, the American Society of Civil Engineers, the National Society of Professional Engineers, and the Associated General Contractors of America, which produces standardized form documents for use on engineering, design and construction projects.

Through separate negotiations, NASBP has been able to furnish standardized bond forms from the construction industry’s three widely recognized standard form providers: ConsensusDOCSEJCDC, and American Institute of Architects (AIA). Through discussions with the AIA, NASBP secured permission to create NASBP-equivalents of the current editions of their bid bond document, AIA Document A310-2010, and AIA’s performance bond and payment bond document, AIA Document A312-2010.
