Federal Report

Federal: Last week, Sam Graves (R-MO), Chair of the House Transportation & Infrastructure Committee (T&I), announced this would be his last term serving as the Representative from the Sixth District of Missouri. According to the Chairman, “for 26 years, I have had the privilege of serving in Congress, culminating in becoming the Chairman of the House Transportation and Infrastructure Committee and passing some of the most significant legislation in our nation’s history. Graves’s added, “the responsibility entrusted to me is not something I have ever taken for granted. Not for a single day.” NASBP had the opportunity of working with the Congressman on important policy matters during his tenure as Chairman of the House Small Business Committee and in his current role as Chair of T&I. Chairman Graves’ leadership, steady-hand and his willingness to work across the aisle, will be missed on Capitol Hill. To date, 68 Members of Congress, which includes 57 House members and 11 Senators have announced they will not seek reelection in November.

State Report

CO HB 1311 (Duran) Amends CO Revised Statutes 38-46-101 to permit a subcontractor or contractor to provide a retainage bond in an amount not to exceed five percent of the amount of the money earned by subcontractor or contractor in lieu of withholding retainage for private contracts. HB 1311 has passed both Chambers.

 

CO SB 74 (Carson) Amends Colorado Revised Statutes, 38-22-101 (Liens in favor of whom – when filed) to clarify penalties related to claiming excessive amounts in disputes over public construction bonds. The bill specifies that claims are not considered excessive if there is a good faith belief that the amount claimed is due, even if a court awards a lesser amount. The bill provides for the inclusion of costs from delays or disruptions in claims for liens and verified statements of claim. SB 74 passed the legislature and was signed by the governor on April 6. While the bill was signed into law, it will not officially take effect until it is approved by the voters during the November 2026 election. 

 

VT H.944 (Transportation Committee) amends 19 V.S.A. § 10 by waiving and/or increasing statutory bond threshold requirements for VTDOT projects from $100,000 to $250,000. On March 26, H.944 passed the House 84-46 and is currently before the Senate Transportation Committee. NASBP sent a letter to the House and Senate Transportation Committees in opposition to the bill.
